By accessing or using this Site, you agree to be bound by these Terms and Conditions and all applicable laws and regulations. If you disagree, please do not use this Site.
1. Use of Website
You agree to use this Site only for lawful purposes and in a manner consistent with the intended campaign objectives. You may not use the Site:

2. Intellectual Property
All content on this Site—including text, logos, images, videos, graphics, and layout—is the property of Fujinaka for 26 or its content suppliers and is protected by copyright, trademark, and other laws. Unauthorized use, reproduction, or distribution is prohibited.
3. Donations
All donations made through the Site must comply with campaign finance laws. By donating, you certify that:

All donation transactions are processed securely via a third-party payment processor. Fujinaka for 26 does not store your financial information.
4. Campaign Finance Laws
Political contributions to Friends of Janel Fujinaka are subject to Hawaiʻi State and Federal campaign finance laws. We make every effort to ensure compliance with these laws; however, you are ultimately responsible for ensuring that your contributions remain within legal limits.
Under Hawaiʻi State law, the maximum allowable contribution is $2,000 per election for individuals, partnerships, or noncandidate committees for candidacy in the Hawaiʻi State House of Representatives. Federal law also prohibits contributions from corporations, labor unions, federal contractors, and foreign nationals.
We track your contributions made through other platforms, fundraisers, or direct donations. If you contribute through multiple sources, it is your responsibility to ensure your total contributions do not exceed the legal limits.
Please contribute using your funds and refrain from donating on behalf of another person or entity. Contributions are not tax-deductible for federal income tax purposes.
If you are in a position to make large or frequent donations, we appreciate your support and we kindly request that you do so with care and consideration for the law. Let’s keep our campaign pono and our compliance clean.

10. Other Laws
Donations to charities (501(c)(3) organizations) and social welfare groups (501(c)(4) organizations) are not subject to any contribution limits. You may make unlimited donations to these groups on the site. ActBlue cannot be responsible for your treatment of these donations on your tax returns. Charitable contributions are tax-deductible for federal income tax purposes. Social welfare donations are not tax deductible as charitable contributions. We will do our best to provide you with all relevant information regarding the tax treatment of donations to the entities on our site, including the percentage of your donation that may be used for lobbying activities (please refer to your receipt). However, it is your responsibility to report your donations accurately as required and to pay the taxes due. We recommend consulting your tax adviser or tax preparer if you have any questions.

We may periodically publish branding guidelines (e.g. font usage, colors, size, and placement). By using any campaign materials, you agree to comply with those guidelines. All goodwill associated with such marks remains the sole property of Friends of Janel Fujinaka.
All intellectual property rights not explicitly granted in these Terms of Use are reserved.
13. User-Contributed Content
Any content submitted by users to FujinakaFor26.com, including comments, testimonials, photos, or other media, is covered under the same Creative Commons license as described above. In addition, by submitting content, you grant Friends of Janel Fujinaka a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, and distribute this content in any format or media, including for campaign use.
You are solely responsible for any content you post. This means:

14. Refund Policy
Friends of Janel Fujinaka will make every reasonable effort to accommodate refund requests. We will honor refunds requested for valid reasons such as input errors (e.g., duplicate donations or incorrect amounts). However, contributions cannot be refunded based on changes in political preference, personal opinions, or dissatisfaction with campaign messaging or events.
All refund requests are subject to the availability of funds. Because campaign contributions are typically expended quickly and reported to the Hawaiʻi Campaign Spending Commission, we can only issue refunds if the funds are still available and uncommitted. For this reason, refund requests should be submitted as soon as possible after the original contribution.
Refunds will only be issued to the original payment method used at the time of the donation. If we are unable to process a refund, we will refer you to your payment provider for further resolution.
We reserve the right to refuse a refund request for any reason, particularly if the request does not comply with state or federal campaign finance laws.
Our system is monitored for fraudulent activity, including unauthorized credit card use. Contributions identified as fraudulent will be refunded automatically once verified.

15. Recurring Contribution and Cancellation Policy
For your convenience, we may offer the ability to make recurring contributions through a secure payment platform. By enrolling in a recurring donation, you authorize us to charge your designated account at regular intervals (e.g., monthly) for the amount you selected. You may cancel your recurring contribution at any time by following the instructions in your donation confirmation email or by contacting us directly at janel.fujinaka@fujinakafor26.com.
We will never alter the amount, frequency, or recipient of your recurring donation without your explicit consent.
16. Reallocation of Unprocessed Contributions
In the rare event that a contribution is not processed, deposited, or accepted due to administrative error or donor request, and a refund is not feasible, the funds will be used to support the general campaign operations of Friends of Janel Fujinaka in accordance with Hawaiʻi campaign finance law.
17. Disclaimer of Warranties and Limitation of Liability
This website and all associated campaign content is provided "as is" and "as available." Friends of Janel Fujinaka makes no guarantees, warranties, or representations, express or implied, regarding the accuracy, reliability, or completeness of this site or its content. You agree that your use of this site is at your sole risk.
